Do I have to submit form 172 or 173 to the tax authorities?

The answer is No. As an individual user who buys, sells, or exchanges cryptocurrencies through Bit2Me, you do not have to file forms 172 or 173 with the Spanish Tax Agency (Hacienda).

These forms are informational in nature and are designed to be filed by certain entities and legal persons.


Who is required to file Model 172 and 173?

The obligation to file these forms falls on individuals and entities resident in Spain and permanent establishments in Spanish territory of non-resident individuals or entities, provided they meet certain criteria.

Below, we detail what type of activity generates this obligation, for informational purposes:


Model 172 (Balances of virtual currencies):

  • It must be filed by those who provide services to safeguard private cryptographic keys on behalf of third parties as their main activity or in connection with another activity (i.e., cryptocurrency custody services).


Model 173 (Operations with virtual currencies):

  • It must be filed by those who provide services to safeguard private cryptographic keys on behalf of third parties as their main activity or in connection with another activity (to hold, store, and transfer virtual currencies).

  • Those who provide exchange services between virtual currencies and fiat currency or between virtual currencies.

  • Those who intermediate in the operations in any way.

  • Issuers of ICOs (Initial Coin Offerings).

  • Launchpads.


Important: Although you do not have to file these forms, remember that the Income Tax Return (Model 100) is the mandatory way to declare your capital gains or losses derived from the purchase, sale, or exchange of cryptocurrencies.
